Buyer Declaration & Acknowledgement

Introduction

This Buyer Declaration & Acknowledgement ("Declaration") forms an integral part of the Brokers99 Terms & Conditions and Privacy Policy.

By selecting "I Agree", verifying your mobile number through OTP, electronically signing, scheduling a site visit, submitting an enquiry, making an offer, or otherwise using Buyer-related services on the Platform, you voluntarily acknowledge and agree to the declarations contained herein.

Identity Declaration

I declare that:

• I am at least eighteen (18) years of age.
• I possess the legal capacity to enter into binding contracts under the laws of India.
• All information provided by me is true, accurate, complete, and not misleading.
• I shall promptly update any information that becomes inaccurate.

I understand that providing false information may result in suspension or termination of my account and may expose me to legal action.

Purpose of the Platform

I understand and acknowledge that Brokers99 is a technology platform designed to facilitate communication and business management between Buyers, Sellers, Property Owners, and Brokers.

Brokers99 is not the owner of any listed property, a real estate broker in relation to my transaction, a legal advisor, financial advisor, chartered accountant, registered valuer, architect, structural engineer, government authority, or guarantor of any transaction.

I understand that any sale, purchase, lease, or rental transaction is conducted directly between me and the relevant Seller or through an independent Broker.

Independent Verification

I acknowledge that I am solely responsible for conducting my own due diligence before entering into any transaction.

I agree that I shall independently verify, either personally or through qualified professionals, all material aspects of the property, including ownership, title, encumbrances, pending litigation, revenue records, land use zoning, building approvals, Occupancy/Completion certificates, RERA registration, outstanding taxes/dues, measurements, physical/structural condition, and possession status. I understand that I must not rely solely upon information available on the Platform.

Property Information

I understand that property descriptions, photos, videos, maps, pricing, and measurements displayed on the Platform are provided by Brokers, Sellers, Owners, or Developers. Brokers99 does not independently verify every property listing. I accept responsibility for verifying accuracy before making commitments.

AI Disclaimer

I acknowledge that AI-generated locality descriptions, investment insights, recommendations, or summaries may contain errors, be incomplete, or become outdated, and do not constitute professional advice. Purchasing decisions remain my independent judgment.

Site Visit Declaration

Before attending site visits, I declare that I shall behave respectfully, avoid causing damage, follow safety rules, and respect occupant privacy. I acknowledge that site visits are undertaken at my own risk.

Brokerage Disclosure

I understand that brokerage arrangements are separate contracts between me and the Broker. Brokers99 does not determine or collect these fees unless expressly stated.

Communication Consent

I voluntarily authorize Brokers99 and authorized Brokers to contact me (telephone, SMS, WhatsApp, email) regarding enquiries, site visits, recommendations, updates, and customer support.

Privacy Acknowledgement

I acknowledge reading the Privacy Policy. I understand that my details may be shared with relevant Brokers or Sellers to facilitate enquiries or property transactions, subject to applicable law.

Fraud Prevention Declaration

I declare that I shall not submit false enquiries, use false identities, upload forged documents, attempt payment fraud, or mislead Brokers or Sellers.

No Guarantee of Transaction

I understand that Brokers99 does not guarantee property availability, offer acceptance, completion of transactions, appreciation, rental income, or financing approvals.

Limitation of Platform Responsibility

I acknowledge that Brokers99 is not responsible for title defects, construction quality, hidden liabilities, broker/seller misrepresentations, or delays. Nothing in this Declaration limits liability that cannot legally be excluded.

Electronic Consent

I acknowledge that electronic acceptance of this Declaration constitutes legally binding consent. OTP verification may be used to authenticate my identity.

Governing Law

This Declaration shall be governed by the laws of India. Disputes shall fall under the exclusive jurisdiction of competent courts in Shimla, Himachal Pradesh, India.

Buyer Confirmation

By selecting "I Agree", verifying my mobile number, electronically signing, or continuing to use services, I confirm that I have read, understood, and voluntarily accept all terms of this Declaration.
