AI Usage Policy & AI Disclaimer

PART I – Purpose

This Policy establishes responsible AI usage, promotes transparency, protects Users, prevents misuse of AI, defines User responsibilities, explains limitations of AI-generated content, and supports compliance with applicable laws.

PART II – Scope

This Policy applies to every AI-powered feature available on the Platform. This includes, but is not limited to, the following capabilities:

PART III – AI Services

The Platform may use Artificial Intelligence to assist Users by generating property descriptions, property summaries and comparisons, locality information, marketing captions, social media posts, buyer/seller recommendations, investment summaries, AI chat responses, email/WhatsApp/SMS drafts, follow-up reminders, CRM insights, business analytics, document summaries, and OCR extracted information.

PART IV – Human Oversight

Every User acknowledges that AI-generated outputs require human review, should be independently verified, may contain inaccuracies, may omit important information, may become outdated, and may reflect incomplete context.

Users remain solely responsible for approving or rejecting AI-generated content before using, relying on, or publishing it.

PART V – No Professional Advice

AI-generated outputs are provided solely for informational and operational assistance. AI outputs shall not be considered advice or legal guarantees in any of the following fields:

PART VI – AI Property Information

AI may generate property descriptions, amenities, locality summaries, investment highlights, comparisons, and estimated rental information. The Company does not guarantee that such information is accurate, complete, current, or suitable for investment decisions. Property owners and Brokers remain responsible for verifying all published information.

PART VII – AI Document Assistance

AI may assist in generating agreements, notices, emails, property advertisements, marketing material, legal templates, checklists, and reports. Such documents are templates and operational drafts only. Users remain responsible for obtaining independent legal advice where appropriate before relying upon or executing any document.

PART VIII – AI Image Processing

Where AI is used for image enhancement, background removal, optimization, OCR, categorization, or property recognition, the User acknowledges that AI processing may not always accurately represent the Property. Original images should be preserved where required.

PART IX – AI Search & Recommendations

AI recommendations may be based on property preferences, user activity, CRM history, search behaviour, geographic preferences, budget, and Platform analytics. Recommendations are probabilistic and do not constitute legal guarantees or formal endorsements.

PART X – Prohibited AI Usage

Users are strictly prohibited from using the platform's AI tools to:

PART XI – AI Ethics

Users agree to use AI responsibly — reviewing AI output, correcting inaccuracies, respecting intellectual property and privacy, avoiding deceptive practices, and using AI in good faith. Responsible AI usage helps maintain trust across the Platform.

PART XII – AI Training Data

Unless expressly stated otherwise:

• Customer-specific confidential data will not be intentionally used to train public AI models without appropriate authorization or another lawful basis.
• AI providers engaged by the Company may process data solely for providing the requested AI functionality, subject to contractual safeguards.
• The Company may use anonymized or aggregated operational data to improve Platform performance where permitted by applicable law and its Privacy Policy.

PART XIII – User Responsibility

The User remains solely responsible for every AI-generated property description, advertisement, message, report, email, agreement, social media post, and recommendation published by the User. Publishing AI-generated content constitutes acceptance of responsibility for such content.

PART XIV – Data Privacy

AI services may process property data, CRM information, user prompts, uploaded documents, images, and messages. Such processing shall be governed by the Privacy Policy, Data Processing Agreement, and applicable privacy laws.

PART XV – Intellectual Property

Users shall ensure that prompts, uploaded material, and generated content do not knowingly infringe copyright, trademark, patent, trade secret, design rights, or other intellectual property rights.

PART XVI – Third-Party AI Services

The Platform may integrate third-party AI providers. Accordingly, AI services may occasionally be unavailable, response quality may vary, AI providers may change models without notice, and certain features may depend upon third-party availability. The Company is not responsible for outages or changes attributable solely to third-party AI providers.

PART XVII – Platform Rights

The Company may limit or suspend AI features, modify AI models, introduce usage quotas, restrict abusive prompts, block prohibited content, and disable AI features where required for security, compliance, or operational reasons.

PART XVIII – AI Disclaimer

The Company makes no representation or warranty that AI-generated outputs will be correct, complete, reliable, current, error-free, unbiased, or suitable for any specific purpose. AI outputs are generated automatically and may contain inaccuracies despite reasonable safeguards.

PART XIX – Limitation of Liability

To the fullest extent permitted by applicable law, the Company shall not be liable for losses arising from reliance on AI-generated information, AI inaccuracies or hallucinations, incorrect recommendations, missing information, translation errors, OCR errors, AI-generated descriptions or investment summaries, decisions made solely on AI output, or temporary unavailability of AI services.

PART XX – Compliance with Law

Users agree to use AI features in compliance with applicable laws including the Information Technology Act, 2000; Digital Personal Data Protection Act, 2023; Copyright Act, 1957; Consumer Protection Act, 2019; Real Estate (Regulation and Development) Act, 2016; and any applicable Central, State, or local laws.

PART XXI – Modifications

The Company may modify, replace, suspend, or discontinue AI features at any time. Material changes to this Policy may be communicated through the Platform or by other appropriate means.

PART XXII – Governing Law

This Policy is governed by the laws of India. Subject to any arbitration agreement and mandatory provisions, disputes relating to AI usage shall fall within the jurisdiction of competent courts at Shimla, Himachal Pradesh, India.

PART XXIV – User Acknowledgement

By creating an account, using any AI feature, clicking "I Agree", completing OTP verification, or continuing to use AI-powered services on the Brokers99 Platform, the User acknowledges and agrees that:

• They have read and understood this AI Usage Policy & AI Disclaimer.
• They understand that AI is an assistive technology and not a substitute for professional judgment.
• They will independently review and verify AI-generated outputs before relying upon or publishing them.
• They will not use AI features for unlawful, fraudulent, deceptive, or harmful purposes.
• They understand that the Company may maintain prompts, AI interaction logs, authentication records, electronic evidence, and related electronic audits for security, compliance, fraud prevention, and dispute resolution, subject to the Privacy Policy, DPA, and applicable law.
• They voluntarily accept this Policy and agree to use AI features responsibly in accordance with all applicable laws and Platform policies.
